Abstract

Islamic legal policy in Indonesia has long been dominated by a formalistic paradigm that measures policy success by the extent to which fiqh norms are positivized into state regulation, yet this approach increasingly reveals its limitations in producing substantive transformation for society. This study aims to reconstruct the paradigm of Islamic legal policy, shifting it from symbolic formalization toward a Maq??id-Based Legal Policy, a policy evaluation framework that measures legal success by its actual contribution to public welfare (maslahah), justice, and the protection of citizens' rights. Using a normative-juridical approach through doctrinal analysis and comparative policy review, this study examines national legislation, classical and contemporary fiqh literature, and the dynamics of Islamic legal policy reform, employing Jasser Auda's systems approach, which emphasizes connectivity, cognitive openness, multidimensionality, and purposiveness. The findings reveal two main points. First, legal policy formulation and implementation showing the strongest effectiveness and social acceptance have followed an integrative-substantive path, as evidenced in family law, Islamic economic, and environmental-natural resource policies. Second, maq??id-based Islamic values operate not as an exclusive system but as a dialogical source of values that can contribute ethically to the formulation of pluralistic national legal policy, in line with Pancasila. This study concludes that Maq??id-Based Legal Policy offers an integrative paradigm capable of bridging the tension between sharia and state law, while providing a policy evaluation framework that can be operationalized across sectors.
