Konstitusionalitas Kebijakan Publik Berbasis E-Governance dalam Reformasi Birokrasi Digital di Indonesia

The transformation of technology-based governance through e-Governance public policies has become an important aspect of bureaucratic reform in Indonesia. Nevertheless, its implementation continues to raise constitutional concerns related to the protection of citizens’ rights, digital inequality, bureaucratic transparency, personal data security, and the accountability of state authorities in the use of digital technology. This article examines the constitutionality of e-Governance-based public policies within the framework of digital bureaucratic reform in Indonesia and identifies an appropriate governance model for developing democratic and socially just digital administration. The study employs normative legal research using statutory, conceptual, and socio-legal approaches, and is analyzed through the perspectives of the rule of law, good governance, responsive governance, and digital constitutionalism. The findings indicate that the implementation of e-Governance in Indonesia has not fully reflected the principles of the rule of law and good governance due to several persistent challenges, including unequal access to digital public services (digital divide), limited digital literacy, weak protection of personal data, restricted public participation, and the potential misuse of digital technology in administrative governance. These conditions demonstrate that digital bureaucratic reform in Indonesia remains predominantly oriented toward administrative modernization and bureaucratic efficiency rather than the strengthening of digital democracy, social justice, and constitutional rights protection. Therefore, digital bureaucratic reform requires the reconstruction of a responsive e-Governance model that prioritizes transparency, public participation, digital rights protection, and social justice as the foundation of constitutional and inclusive digital governance.
[Transformasi tata kelola pemerintahan berbasis teknologi melalui kebijakan publik e-Governance telah menjadi aspek penting dalam reformasi birokrasi di Indonesia. Namun demikian, implementasinya masih menimbulkan berbagai persoalan konstitusional yang berkaitan dengan perlindungan hak-hak warga negara, ketimpangan digital, transparansi birokrasi, keamanan data pribadi, serta akuntabilitas otoritas negara dalam penggunaan teknologi digital. Artikel ini mengkaji konstitusionalitas kebijakan publik berbasis e-Governance dalam kerangka reformasi birokrasi digital di Indonesia serta mengidentifikasi model tata kelola yang tepat dalam mewujudkan administrasi digital yang demokratis dan berkeadilan sosial. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan socio-legal, yang dianalisis melalui perspektif negara hukum, good governance, responsive governance, dan konstitusionalisme digital. Hasil penelitian menunjukkan bahwa implementasi e-Governance di Indonesia belum sepenuhnya mencerminkan prinsip negara hukum dan good governance karena masih terdapat berbagai tantangan, seperti ketimpangan akses terhadap layanan publik digital (digital divide), rendahnya literasi digital, lemahnya perlindungan data pribadi, terbatasnya partisipasi publik, serta potensi penyalahgunaan teknologi digital dalam tata kelola administrasi pemerintahan. Kondisi tersebut menunjukkan bahwa reformasi birokrasi digital di Indonesia masih lebih berorientasi pada modernisasi administrasi dan efisiensi birokrasi daripada penguatan demokrasi digital, keadilan sosial, dan perlindungan hak-hak konstitusional. Oleh karena itu, reformasi birokrasi digital memerlukan rekonstruksi model e-Governance yang responsif dengan menempatkan transparansi, partisipasi publik, perlindungan hak digital, dan keadilan sosial sebagai landasan utama dalam mewujudkan tata kelola digital yang konstitusional dan inklusif.]
