Abstract

This study analyzes the fulfillment of inmates' right to sentence remission at the Class IIA Correctional Institution in Banda Aceh and identifies its key implementation barriers. Using empirical legal research with a normative-juridical and descriptive approach, data were gathered through field research and literature review, then analyzed by comparing legal provisions against actual practice. The findings indicate that while remission—comprising both general and special categories—is implemented through formal submission to the Directorate General of Corrections for eligible inmates, major obstacles persist. The primary challenges involve incomplete administrative documentation, particularly regarding court decisions and prosecutorial execution documents, alongside poor interinstitutional coordination. Consequently, the effective realization of remission rights relies heavily on administrative readiness, staff capacity, and inter-agency cooperation beyond mere legal compliance. Strengthening information transparency, administrative management, and coordination between correctional institutions and relevant judicial agencies is essential to ensure a more effective, objective process that delivers legal certainty for inmates.
