The journal is dedicated to advancing rigorous discussions on the protection of human dignity, the realization of justice, and the development of legal norms in both domestic and international contexts.</p> <p data-start="844" data-end="1422">In an increasingly interconnected global environment, legal developments in one jurisdiction inevitably influence and intersect with others. <strong data-start="985" data-end="1013">Human Rights et Justicia</strong> responds to this reality by encouraging comparative and transnational legal analyses that explore how human rights principles and concepts of justice are interpreted, implemented, and contested across different legal traditions and socio-cultural settings. The journal seeks to strengthen comparative legal scholarship while maintaining a clear focus on human rights law and justice-oriented legal reasoning.</p> <p data-start="1424" data-end="1909">The scope of <strong data-start="1437" data-end="1465">Human Rights et Justicia</strong> encompasses public law, constitutional law, international human rights law, legal theory, legal philosophy, and justice studies, including engagements with Islamic law and other normative legal traditions. The editorial board particularly welcomes interdisciplinary contributions that integrate law with social sciences, humanities, and policy studies, as well as manuscripts that employ comparative methods in legal analysis and adjudication.</p> <p data-start="1911" data-end="2326"><strong data-start="1911" data-end="1939">Human Rights et Justicia</strong> is an open-access, double-blind peer-reviewed journal committed to high ethical standards in academic publishing. <p>Human rights are fundamental rights inherent in every individual and constitute a core element of the rule of law. However, despite their formal recognition within the Indonesian legal system, persistent human rights violations continue to occur, indicating a gap between legal norms and their practical enforcement. In addition, existing studies on human rights in Indonesia tend to be partial, as they often examine either Western legal perspectives or Islamic perspectives separately, without integrating them within a comprehensive historical framework. This study aims to reconstruct the historical relationship between law and human rights in Indonesia through a comparative analysis of Western and Islamic perspectives. This research employs normative legal methods using statutory, conceptual, and historical approaches. The findings reveal that the development of human rights in Indonesia is shaped by the interaction between Western legal traditions rooted in natural law theory and Islamic traditions based on divine values. Although these perspectives differ in their philosophical foundations, they converge in emphasizing human dignity as a fundamental value. This study contributes by offering an integrative framework that bridges these two traditions in understanding the relationship between law and human rights in Indonesia, and highlights the importance of aligning legal norms, moral values, and law enforcement practices in achieving a substantive rule of law.</p> <p>[<em>Hak asasi manusia merupakan hak-hak mendasar yang melekat pada setiap individu dan merupakan unsur inti dari supremasi hukum. Namun, meskipun telah diakui secara formal dalam sistem hukum Indonesia, pelanggaran hak asasi manusia terus terjadi yang menunjukkan adanya kesenjangan antara norma-norma hukum dan penegakannya dalam praktik. Selain itu, berbagai studi yang ada mengenai hak asasi manusia di Indonesia cenderung bersifat parsial, karena hanya mengkaji perspektif hukum Barat atau perspektif Islam secara terpisah, tanpa mengintegrasikannya dalam kerangka sejarah yang komprehensif. Penelitian ini bertujuan untuk merekonstruksi hubungan historis antara hukum dan hak asasi manusia di Indonesia melalui analisis komparatif antara perspektif Barat dan Islam. </em><em>Penelitian ini menggunakan metode hukum normatif dengan pendekatan yuridis, konseptual, dan historis. Hasil penelitian menunjukkan bahwa perkembangan hak asasi manusia di Indonesia dipengaruhi oleh hubungan antara tradisi hukum Barat yang berakar pada teori hukum alam dan tradisi Islam yang didasarkan pada nilai-nilai ilahi. Meskipun kedua perspektif ini memiliki landasan filosofis yang berbeda, keduanya memiliki kesamaan dalam menekankan martabat manusia sebagai nilai fundamental. Studi ini memberikan kontribusi dengan menawarkan kerangka integratif yang menjembatani kedua tradisi tersebut dalam memahami hubungan antara hukum dan hak asasi manusia di Indonesia, serta menegaskan pentingnya menyelaraskan norma-norma hukum, nilai-nilai moral, dan praktik penegakan hukum dalam mewujudkan supremasi hukum yang substantif.</em>]</p>Jamaludin Jamaludin, Tata Eliestiana Dyah A, Andi Mulyan

<p>Advances in information technology have propelled social media into a dominant space in the formation of public opinion, including in responses to legal cases. This situation has given rise to the phenomenon of ‘trial by social media’, namely the practice of public judgement against individuals prior to a final and binding court ruling. This study aims to examine the implications of this phenomenon for the protection of human rights and the principle of justice. This research is situated within a normative legal framework, employing a descriptive-analytical qualitative approach through a literature review. The analysis examines legal norms, legal principles, and relevant academic literature concerning the issues of freedom of expression, the protection of individual rights, and due process of law. Research findings indicate that trial by social media has the potential to violate the principle of the presumption of innocence, the right to privacy, and the right to dignity and reputation. Furthermore, this phenomenon contributes to an increase in digital bullying, the dissemination of personal data, and social stigma with long-term consequences. From a justice perspective, public opinion pressure on social media has the potential to influence the independence and objectivity of law enforcement, thereby creating tension between procedural justice and social expectations. These findings confirm a shift from normative legal authority towards socially constructed legitimacy in the digital sphere. Therefore, there is a need to strengthen regulations, improve digital literacy, and ensure consistent law enforcement to maintain a balance between freedom of expression and the protection of human rights.</p> <p>[<em>Perkembangan teknologi informasi telah mendorong media sosial menjadi ruang dominan dalam pembentukan opini publik, termasuk dalam merespons perkara hukum. Kondisi ini melahirkan fenomena trial by social media, yaitu praktik penghakiman publik terhadap individu sebelum adanya putusan pengadilan yang berkekuatan hukum tetap. Penelitian ini bertujuan untuk mengkaji implikasi fenomena tersebut terhadap perlindungan hak asasi manusia dan prinsip keadilan. Penelitian ini diposisikan dalam kerangka yuridis normatif dengan menggunakan pendekatan kualitatif deskriptif-analitis melalui studi kepustakaan. Analisis dilakukan terhadap norma hukum, asas-asas hukum, serta literatur ilmiah yang relevan dengan isu kebebasan berekspresi, perlindungan hak individu, dan due process of law. Hasil penelitian menunjukkan bahwa trial by social media berpotensi melanggar asas praduga tak bersalah, hak atas privasi, serta hak atas kehormatan dan nama baik. Selain itu, fenomena ini turut mendorong meningkatnya praktik perundungan digital, penyebaran data pribadi, dan stigma sosial yang berdampak jangka panjang. Dari perspektif keadilan, tekanan opini publik di media sosial berpotensi memengaruhi independensi dan objektivitas penegakan hukum, sehingga menimbulkan ketegangan antara keadilan prosedural dan ekspektasi sosial. Temuan ini menegaskan adanya pergeseran dari otoritas hukum normatif menuju legitimasi yang dibentuk secara sosial di ruang digital. <p>Energy governance has become an increasingly important issue in resource-rich regions where economic development driven by energy extraction often intersects with concerns about human rights protection. In many developing countries, including Indonesia, the expansion of energy projects has generated significant economic benefits while simultaneously raising questions regarding the protection of local communities’ rights, the equitable distribution of economic benefits, and the effectiveness of legal institutions in regulating energy resources. This article examines how energy governance frameworks influence economic development and human rights protection in resource-rich regions. The study adopts a socio-legal perspective that positions energy governance within broader institutional and regulatory structures shaping the relationship between economic growth and community rights. Using a qualitative approach, the research employs descriptive analysis and content analysis of relevant legal frameworks, policy documents, and governance practices related to energy resource management. Through this analysis, the article explores how governance arrangements mediate the interaction between economic development objectives and human rights obligations. The findings indicate that although energy development contributes to regional economic growth, governance challenges, including weak regulatory enforcement and limited community participation, often hinder the effective protection of economic and social rights. Strengthening governance accountability, enhancing institutional coordination, and integrating human rights principles into energy policy are therefore crucial for ensuring more equitable and sustainable development in resource-rich regions.</p> <p>[<em>Tata kelola energi telah menjadi isu yang semakin penting di wilayah kaya sumber daya, di mana pembangunan ekonomi yang didorong oleh ekstraksi energi sering kali beririsan dengan perlindungan hak asasi manusia. Di banyak negara berkembang, termasuk Indonesia, ekspansi proyek energi menghasilkan manfaat ekonomi yang signifikan sekaligus menimbulkan pertanyaan terkait perlindungan hak masyarakat lokal, distribusi manfaat ekonomi yang adil, serta efektivitas institusi hukum dalam mengatur sumber daya energi. </em><em>Artikel ini mengkaji bagaimana kerangka tata kelola energi memengaruhi pembangunan ekonomi dan perlindungan hak asasi manusia di wilayah kaya sumber daya. Penelitian ini menggunakan perspektif sosio-legal yang menempatkan tata kelola energi dalam struktur kelembagaan dan regulasi yang lebih luas, yang membentuk hubungan antara pertumbuhan ekonomi dan hak-hak masyarakat. Menggunakan pendekatan kualitatif, penelitian ini menerapkan analisis deskriptif dan analisis isi terhadap kerangka hukum yang relevan, dokumen kebijakan, serta praktik tata kelola terkait pengelolaan sumber daya energi. Melalui analisis tersebut, artikel ini mengeksplorasi bagaimana pengaturan tata kelola memediasi interaksi antara tujuan pembangunan ekonomi dan kewajiban perlindungan hak asasi manusia. Temuan penelitian menunjukkan bahwa meskipun pembangunan energi berkontribusi terhadap pertumbuhan ekonomi daerah, tantangan tata kelola—termasuk lemahnya penegakan regulasi dan terbatasnya partisipasi masyarakat—sering kali menghambat perlindungan efektif terhadap hak-hak ekonomi dan sosial. <p>Every individual is entitled to a sense of security within their academic pursuits; however, bullying continues to threaten safety in educational environments, including higher education institutions. Despite its prevalence, research on bullying at the university level remains relatively limited compared to other educational settings. This study aims to explore students’ perceptions of bullying from a human rights perspective. Employing a qualitative approach with Creswell’s phenomenological method, data were collected through in-depth, semi-structured interviews with five law students selected using purposive sampling. The findings reveal that bullying is perceived as a complex phenomenon involving not only physical and verbal abuse but also power imbalances between perpetrators and victims, with impacts on psychological, social, and academic aspects. Moreover, students view bullying as a violation of human rights, particularly the rights to security, protection, and human dignity. These findings highlight the need for higher education institutions to establish preventive and educational strategies to address bullying, as well as to encourage active student involvement in creating a safer academic environment.</p> <p>[<em>Setiap individu berhak memperoleh rasa aman dalam menjalani aktivitas akademiknya. Namun, bullying masih menjadi ancaman terhadap keamanan di lingkungan pendidikan, termasuk di perguruan tinggi. Meskipun fenomena ini cukup prevalen, kajian mengenai bullying di tingkat perguruan tinggi masih relatif terbatas dibandingkan dengan jenjang pendidikan lainnya. Penelitian ini bertujuan untuk mengeksplorasi persepsi mahasiswa terhadap bullying dalam perspektif hak asasi manusia. Penelitian ini menggunakan pendekatan kualitatif dengan metode fenomenologi Creswell. Data dikumpulkan melalui wawancara mendalam dengan panduan semi-terstruktur terhadap lima mahasiswa hukum yang dipilih melalui teknik purposive sampling. Hasil penelitian menunjukkan bahwa bullying dipersepsikan sebagai fenomena kompleks yang tidak hanya melibatkan kekerasan fisik dan verbal, tetapi juga ketimpangan kekuasaan antara pelaku dan korban, dengan dampak pada aspek psikologis, sosial, dan akademik. Selain itu, mahasiswa memandang bullying sebagai bentuk pelanggaran hak asasi manusia, khususnya terhadap hak atas rasa aman, perlindungan, dan martabat manusia. <p>This study examines the implementation of Law Number 22 of 2022 on Corrections in the development of juvenile inmates at LPKA Class II Banda Aceh, which still reveals a gap between legal norms and empirical practices. The objective of this research is to analyze the effectiveness of a human rights–based correctional approach in enhancing the personality and independence of juvenile inmates. This study employs a descriptive qualitative method with an empirical approach, utilizing primary data obtained through in-depth interviews and observations, as well as secondary data derived from relevant literature and official documents. The findings indicate that the fulfillment of fundamental rights, such as education, healthcare, spiritual guidance, and vocational training, significantly contributes to positive transformations in mindset, attitudes, and behavior. Furthermore, cross-sectoral collaboration strengthens the effectiveness of rehabilitation programs. However, implementation remains constrained by limited resources and external social factors. This study concludes that a human rights–based approach is effective in supporting juvenile rehabilitation, yet requires institutional strengthening, capacity building, and sustained inter-agency collaboration.</p> <p>[<em>Penelitian ini mengkaji implementasi Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan dalam pembinaan narapidana anak di LPKA Kelas II Banda Aceh, yang masih menunjukkan adanya kesenjangan antara norma hukum dan praktik empiris. Tujuan penelitian ini adalah menganalisis efektivitas pendekatan pemasyarakatan berbasis hak asasi manusia dalam meningkatkan kepribadian dan kemandirian narapidana anak. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan empiris, memanfaatkan data primer yang diperoleh melalui wawancara mendalam dan observasi, serta data sekunder yang diambil dari literatur dan dokumen resmi yang relevan. Temuan menunjukkan bahwa pemenuhan hak-hak dasar, seperti pendidikan, layanan kesehatan, bimbingan rohani, dan pelatihan kejuruan, berkontribusi signifikan terhadap transformasi positif dalam pola pikir, sikap, dan perilaku. Selain itu, kolaborasi lintas sektor memperkuat efektivitas program rehabilitasi. Namun, implementasi masih terkendala oleh keterbatasan sumber daya dan faktor sosial eksternal.
