These transformations have generated new ethical challenges that cannot be fully addressed through technological approaches alone. This article aims to analyze the relevance of maqasid al-shariah in the development of contemporary fiqh as a foundation for establishing global algorithmic ethics in the era of artificial intelligence. This study employs a qualitative method with a library research approach through the analysis of literature on contemporary fiqh, maqasid al-shariah theory, as well as studies on technology ethics and artificial intelligence. The findings reveal that the principles of maqasid al-shariah, such as the protection of religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-‘aql), lineage (hifz al-nasl), and property (hifz al-mal), possess strong relevance in responding to issues related to digital algorithms, data privacy, AI bias, information manipulation, and inequality in technological access. The maqasid approach functions not only as a normative instrument within Islamic law but also as a universal ethical framework emphasizing public welfare, justice, transparency, and social responsibility in the development of global technology. This article argues that the integration of maqasid al-shariah with contemporary AI discourse can generate an adaptive, humanistic, and responsive fiqh paradigm capable of addressing the dynamics of modern digital civilization.</p> <p>Perkembangan kecerdasan buatan (Artificial Intelligence/AI) telah menghadirkan transformasi besar dalam berbagai aspek kehidupan manusia, mulai dari ekonomi, pendidikan, kesehatan, hukum, hingga praktik keberagamaan. Perubahan tersebut memunculkan tantangan etis baru yang tidak sepenuhnya dapat dijawab melalui pendekatan teknologi semata. Artikel ini bertujuan menganalisis relevansi maqasid al-syariah dalam pengembangan fikih kontemporer sebagai dasar pembentukan etika algoritmik global di era kecerdasan buatan. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan melalui analisis terhadap literatur fikih kontemporer, teori maqasid al-syariah, serta kajian etika teknologi dan kecerdasan buatan. Hasil penelitian menunjukkan bahwa prinsip-prinsip maqasid al-syariah, seperti perlindungan agama (hifz al-din), jiwa (hifz al-nafs), akal (hifz al-‘aql), keturunan (hifz al-nasl), dan harta (hifz al-mal), memiliki relevansi kuat dalam merespons persoalan algoritma digital, privasi data, bias kecerdasan buatan, manipulasi informasi, serta ketimpangan akses teknologi. Pendekatan maqasid tidak hanya berfungsi sebagai instrumen normatif dalam hukum Islam, tetapi juga mampu menjadi kerangka etik universal yang menekankan kemaslahatan, keadilan, transparansi, dan tanggung jawab sosial dalam pengembangan teknologi global. The method used in this study is normative legal research with an approach that focuses on legislation and concepts. The legal sources used include primary legal materials such as regulations, especially Law Number 1 of 2024 concerning the Second Amendment to the ITE Law and the Criminal Code, as well as secondary legal materials consisting of fiqh literature and relevant academic analysis. The findings of this study show that according to positive law in Indonesia, criminal liability for attacks on honor in the digital world is based on elements of unlawful acts, mistakes, the ability to account for behavior, and there is no reason to be forgiven, with the character of a complaint. On the other hand, in Islamic criminal law, this act can be categorized as jar?mah if it meets the requirements of al-rukn al-syar'?, al-rukn al-m?d?, and al-rukn al-adab?. The study also revealed that most attacks on honor in the digital world fall under the jar?mah ta'z?r classification, which gives the government freedom to choose the type and punishment of the criminal. In addition, the concept of qa?f has important normative relevance as an ethical basis for maintaining honor, although it is specifically only related to accusations of adultery that have no evidence. Therefore, a blend of positive law and Islamic criminal law principles, especially jar?mah ta'z?r, can create a more flexible, balanced, and focused criminal accountability system on the protection of human dignity in the digital age.</p> <p>Studi ini bertujuan untuk menggali analisis mengenai pertanggungjawaban pidana atas tindakan yang merugikan kehormatan di dunia digital, dilihat dari sudut pandang hukum positif di Indonesia dan hukum pidana Islam. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan yang berfokus pada perundang-undangan dan konsep. Sumber hukum yang dipakai mencakup bahan hukum primer seperti peraturan, terutama Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua UU ITE dan KUHP, serta bahan hukum sekunder yang terdiri dari literatur fiqh jinayah dan analisis akademis yang relevan. Temuan penelitian ini menunjukkan bahwa menurut hukum positif di Indonesia, pertanggungjawaban pidana untuk serangan kepada kehormatan di dunia digital didasarkan pada unsur perbuatan melawan hukum, kesalahan, kemampuan untuk mempertanggungjawabkan tingkah laku, serta tidak ada alasan untuk dimaafkan, dengan karakter sebagai delik aduan. Di sisi lain, dalam hukum pidana Islam, tindakan ini dapat dikategorikan sebagai jar?mah jika memenuhi syarat al-rukn al-syar‘?, al-rukn al-m?d?, dan al-rukn al-adab?. Penelitian ini juga mengungkapkan bahwa sebagian besar serangan terhadap kehormatan di dunia digital termasuk dalam klasifikasi jar?mah ta‘z?r, yang memberikan kebebasan kepada pemerintah dalam memilih jenis dan sanksi pidana. Di samping itu, konsep qa?f memiliki relevansi normatif yang penting sebagai dasar etika dalam memelihara kehormatan, meskipun secara spesifik hanya terkait dengan tuduhan zina yang tidak memiliki bukti. In Islamic criminal law, adultery is categorized as a hud?d offense with severe legal consequences, but accompanied by very strict standards of proof as a form of protection of human dignity. This study aims to examine the concept of adultery and its proof, analyze the position of the accusation of adultery as a criminal offense (qadzf), and explain the law on the accusation of adultery against a married couple from the perspective of Islamic jurisprudence (fiqh jinayah). This study uses a normative-juridical method with a fiqh jinayah and ushul fiqh approach. Data sources were obtained through a literature study of the Qur'an, Hadith, and classical and contemporary fiqh books. The results show that the accusation of adultery without sharia proof is a qadzf offense that has strict legal consequences, including criminal sanctions and the loss of credibility of the perpetrator's testimony. In the domestic context, Islamic law provides a specific mechanism in the form of li'?n (recourse to justice) as a just and proportional legal solution. This research confirms that accusations of adultery against a married couple are only valid according to sharia if pursued through the li'?n mechanism. Thus, Islamic criminal law presents itself as a legal system that emphasizes caution, protection of honor, and public welfare, while eliminating the possibility of accusations based solely on prejudice and emotion.</p> <p>Tuduhan zina dalam relasi suami istri merupakan persoalan sensitif yang memiliki implikasi serius terhadap kehormatan individu, keutuhan rumah tangga, dan ketertiban sosial. Dalam hukum pidana Islam, zina dikategorikan sebagai jar?mah hud?d dengan konsekuensi hukum yang berat, namun disertai standar pembuktian yang sangat ketat sebagai bentuk perlindungan terhadap martabat manusia. Penelitian ini bertujuan untuk mengkaji konsep zina dan pembuktiannya, menganalisis kedudukan tuduhan zina sebagai delik pidana (qadzf), serta menjelaskan hukum tuduhan zina terhadap pasangan suami istri dalam perspektif fiqh jinayah. Penelitian ini menggunakan metode normatif-yuridis dengan pendekatan fiqh jinayah dan ushul fiqh. Sumber data diperoleh melalui studi kepustakaan terhadap Al-Qur’an, Hadis, serta kitab-kitab fiqh klasik dan kontemporer. Hasil penelitian menunjukkan bahwa tuduhan zina tanpa pembuktian syar‘i merupakan jar?mah qadzf yang memiliki konsekuensi hukum tegas, termasuk sanksi pidana dan hilangnya kredibilitas kesaksian pelaku. Dalam konteks rumah tangga, syariat Islam menyediakan mekanisme khusus berupa li‘?n sebagai solusi hukum yang adil dan proporsional. This study analyzes the role of such settlements as a basis for terminating investigations under the principle of restorative justice, employing a normative juridical approach and case study method. The findings indicate that amicable settlement effectively realizes restorative justice, although it does not entirely eliminate criminal liability. Furthermore, this study recommends strengthening penal mediation at the police level to enhance the efficiency of law enforcement. This research is expected to fill existing gaps in knowledge and provide a significant contribution to the development of law enforcement policies in handling traffic accident cases.</p> <p>Kecelakaan lalu lintas yang menimbulkan tindak pidana sering kali diselesaikan melalui perdamaian antara penabrak dan korban pada tahap penyidikan, sebagaimana kasus empiris di Polres Klaten. Penelitian ini menganalisis peran perdamaian tersebut sebagai dasar penghentian penyidikan berdasarkan restorative justice, dengan pendekatan yuridis normative dan studi kasus. Hasil menunjukkan bahwa perdamaian efektif mewujudkan keadilan restorative, meskipun tidak menghapus pertanggungjawaban pidana sepenuhnya, serta merekomendasikan penguatan mediasi penal di Tingkat kepolisian untuk efisiensi penegakan hukum.
